Over 5,500 Australian aviation workers are currently excluded from accessing JobKeeper payments because the Morrison Government altered eligibility rules for the scheme.

The aviation workers, who perform work critical to the functioning of the aviation industry such as ground handling and catering services for Dnata and airlines including Air Niugini, were previously eligible for JobKeeper payments as their employer was an Australian resident for tax purposes.

But with the stroke of a pen, PM Scott Morrison and Treasurer Josh Frydenberg pulled the rug out from under these aviation workers and left them without any support.

Hardworking Australians who pay their taxes but have been stood down due to the COVID-19 crisis and are currently struggling to get by without pay should not be denied JobKeeper.

With the $60 billion JobKeeper underspend and 3 million less workers receiving it than anticipated, there is no reason why JobKeeper cannot be expanded for these 5,500 workers.

We’re calling on the Federal Government to fix JobKeeper and close the loophole now.

I am writing to ask you to reverse your changes to the eligibility rules for JobKeeper so that 5,500 aviation workers are not denied financial support during the COVID-19 pandemic.

Dnata is a ground handling company that provides catering, cargo, ramp and customer services to airlines all around the country. The workers perform work critical to the functioning of the aviation industry. But due to the COVID-19 pandemic, the aviation industry has been decimated, and these workers have been stood down since early March.

Their employer Dnata was advised by the ATO on 27 April that they were eligible for JobKeeper because the company was an Australian resident for tax purposes. On Friday, 1 May the Federal Government changed the eligibility rules without notice. This meant that Dnata wasn’t eligible for jobkeeper, because it was 100% owned by the government of Dubai. This is despite the fact Dnata is eligible by all other measures.

And this is not just happening in Dnata. Australians who work for airlines such as Emirates and Qatar are also cut out of JobKeeper support during this difficult time due to this loophole.

This is unfair. Most similar companies are owned by overseas companies, but they receive JobKeeper because they are privately owned.

Dnata pays taxes in Australia. These 5,500 aviation workers pay tax in Australia.

But now the rug has been pulled out from underneath them. They don’t know how they will support their families and pay the bills. Many of them have used up their paid leave entitlements and are struggling to get by without regular pay.

I urge your government to reverse this change to the JobKeeper eligibility rules and close this loophole so that Dnata, and 5,500 affected aviation workers are eligible for JobKeeper.
